Terms of use

§ 1 Provider

StorySpark is offered by [name or company, legal form, address] (“we”). All details are in the imprint.

§ 2 What StorySpark does

StorySpark turns photos and details you enter (characters, their names and traits, the listener's age, a style) into an illustrated children's story. Text, photo descriptions and pictures are made by AI models of other companies (privacy notice, section 5). StorySpark is in a test phase (“beta”): features can change, and we cannot promise constant availability.

§ 3 Who may use StorySpark

§ 4 Your content and your responsibility

§ 5 Stories and pictures

§ 6 What is not allowed

No automated access, no attempts to bypass limits, access controls or safety filters, no stories about real people without their consent, no reselling of the service. If these rules are broken we may block an account; we tell you and give the reason.

§ 7 Prices

During the test phase StorySpark is free, within the limits the app shows. Before anything costs money, we tell you and make a separate contract with you.

§ 8 Availability and changes to the service

We may change or end features, especially during the test phase, where there is a valid reason (for example technical or legal reasons). We tell you in good time about changes that affect you.

§ 9 Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for breaching essential obligations, whose fulfilment makes use possible in the first place and on which you may rely, and only for foreseeable, typical damage. [Lawyer to review]

§ 10 Ending the use

You can end your account at any time; write to us at [contact address]. We then delete your family space, stories, pictures and photos as described in the privacy notice. We can end the contract with [four weeks'] notice; the right to terminate for good cause stays unaffected.

§ 11 Changes to these terms

When these terms change, the new text gets a new version. We show it to you in the app and ask for your agreement before you make new stories. If you do not agree, your finished stories stay and you can end your account.

§ 12 Law and disputes

German law applies. Mandatory consumer protection rules of your country of residence stay unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
